Before using Our Service, you should carefully read the terms and conditions below. Our use of and purchase of our services constitutes agreement to the following terms.

Below you will find the defined words that are in a sentence beginning with a capitalized first letter. The meanings given are both singular and plural.

For these Terms and Conditions:

• Company, We, Us, or Our is used behind Brands – i.e., is referred to as the straight name or Brand.

• The name under which the said [UK] has registered the company is referred to as Company in this Article, and at law, the company is referred to by this name.

• State laws are referred to as such when the laws were made by the governing state.

• Service is a part of the component of the J2ME SDK runtime, and it pertains to a device that can use the Service (a device on which it can run the J2ME SDK).

• Service is the Website and all services as provided by Behind Brands.

• The Company and You are entering into these Terms (also called “Terms”) as a contract.

• Website refers to Behind Brands, accessible from [https://behindbrands.co].

• You means the individual, company, or entity accessing or using the Service, as the case may be.

These definitions will define the whole agreement, and both parties will understand them and agree that the agreements of our site and services will be used properly.

Links to Other Websites

Our Service may contain links to other sites that are not ours to own or control. These are given only as a favor.

As the contents or practices of any such third party sites are not under the brand's control and the brand takes no responsibility for any damages or losses incurred from the use of any of these third party sites.

If you go to all third-party websites through recommendations, we simply suggest you read the policies of those third-party websites.

Termination

However, if you breach any of these Terms, we also reserve the right to suspend or terminate your use of our Service at any time.

Also, we can cease to you from making use of the Service if we think it is probable that you’re going to arouse us or other customers to engage in such activity.

Your use of the Service is terminated immediately upon your use of our Service, if there is any indication or reasonable inference given by you earlier. Meanwhile, the payments that have not been paid are payable.

Limitation of Liability

We will never be able to offer business outcomes at the point we hope to provide useful results. You should consider these services as they are; all services are provided "as is," and it is just to help you, not to replace your own business judgment.

If we aren’t going to repair or replace what we were promised, then you are entitled to no more than the money you paid us for the service that we were supposed to provide.

Disclaimer in either “AS IS” or “AS AVAILABLE”

Our services, website, and its content are provided “as is” and “as available,” without any condition, representation, or warranty, ty including, without limitation, as to closed information, business suitability, accuracy, fitness for purpose, and freedom from defects of that content.

However, there would be no guarantee of security, error-free, and uninterrupted when we provide our services. Different results will be found depending on your industry, strategy, and implementation.

Brands disclaims all warranties, including merchantability, fitness for a particular purpose, non-infringement, and the results may vary.

Indemnification

By using the Service, you agree to indemnify and hold Behind Brands and its affiliates, employees, agents, harmless from any losses, costs, demands, claims, or actions (and including reasonable legal fees) for claims or demands including legal fees of third parties that arise from your use of the Service or your breach of these Terms.

Such protection includes, among other things, disputes over content, third-party access, or missing deadlines due to your inactivity.

However, this clause continues to be effective even after the services are terminated.

Severability and Waiver

If any such provision is invalid or unenforceable, all the remaining provisions shall be stayed, but these Terms shall otherwise remain in full force and effect. A right may only be waived by writing and signed by both parties.

We do not give up our right to enforce any provisions, but in case we don’t do that in the future.

No rights are granted herein except those specifically granted therein, and it is expressly understood that every other right, subject of any loss of right, liability privileges, use or enjoyment of any kind and nature whatsoever, is expressly reserved except as in these Terms.

Translation

Other languages can be translated into the Terms for convenience. Nevertheless, in case of any discrepancy or conflict between the Chinese and English versions, the English version will prevail.

Terms and Conditions Per Specific Service – Behind Brands

General Disclaimer:

Brands behind do not give any guarantee about a specific outcome or result for any service out there.

Amazon may require clients to provide information or documents under its policies. Behind Brands may not be able to provide the service if such documentation is not supplied, and it will not imply or issue any refund.

Brands’ operations are all in accordance with Amazon's Terms of Service and all local, state, executive, and international laws.

1. Amazon Listing Reinstatement Service. This service is applicable to one (1) ASIN per marketplace, with a maximum of 8 hours allocated. The service is considered complete when the ASIN is reinstated, even if the total of 8 hours is not used.

2. UPC to GS1 Barcode Change Service Covers one (1) ASIN per marketplace with 8 hours of service time allocated. Completion is defined as the successful change of the UPC to the designated GS1 barcode.

3. Account Suspension Reinstatement Service: This service supports one (1) Amazon marketplace only, with 8 hours allotted per project. Once the account is reinstated, the service is deemed complete, regardless of unused hours.

4. Brand Name Change Service – Tier 1 Includes 1 to 10 ASINs per marketplace with an 8-hour allocation. Service concludes when the brand name is updated across the specified ASINs, whether or not all 8 hours are utilized.

5. Brand Name Change Service – Tier: 2 Applies to 11 to 30 ASINs per marketplace with 16 hours dedicated. Completion occurs upon successful brand name update for each ASIN listed, regardless of time remaining.

6. Trademark Orders:This service includes the USPTO filing fee, basic trademark research, and simple follow-up communications. Complex USPTO office actions requiring legal argumentation (e.g., descriptiveness, surname objections, or likelihood of confusion) will incur additional charges outside of the base package.

7. Delivery Timelines Some services are delivered within set timeframes, while others vary. Resolution services may take from 2 to 60 days. Clients agree to honor payment terms as long as Behind Brands is actively working on their issue.

8. Termination Policy: Either party may terminate a project, but payments are final unless mutually agreed otherwise. Behind Brands reserves the right to issue partial or full refunds at its discretion if the service cannot be reasonably fulfilled.

Refund Policy: All website orders are non-refundable except where specified below:

• Reinstatement Services: Non-refundable once an appeal is filed. If no appeal is filed and we fail within 90 days, a full refund is available.

• Creative Design Services: Limited to three (3) revision requests. Additional revisions will be charged at $300 each. Final approval via email or phone confirms delivery, with further changes subject to our discretion.

Max Billable Time Per Project

The maximum number of billable hours comes to 8 per project order. Behind Brands is at discretion to ignore any work beyond this and may charge extra.

Communication Policy

Phone calls are not included in website service orders (excluding coaching). We will charge $400 per hour in those cases where phone support is required by us at our discretion.

Coaching Calls

After purchase, sessions are nonrefundable and mandatory to schedule within 1 – 3 months. Unused hours expire after one year from the purchase date. At times, we may choose to supply additional advice by email.

Warranty Exclusions

Brands behind provide these services as stated and don’t make any warranties other than those mentioned. Depending on Amazon’s changing policies, services may change in terms of iterations. We can not guarantee that the services or deliverables will meet the client’s expectations. The services provided by us are not responsible in any way for the course of action taken by the client.
